1. Acceptance of Terms

By accessing or using PHATTIFY (the “Website”, “Service”, or “Platform”), you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

2. Description of Service

PHATTIFY is an online platform that allows users to:

  • Create and send personalised digital greeting cards and wedding invitations using templates, custom messages, and multimedia uploads — including photos, videos, audio, and 3D models.
  • Deliver cards privately via email with optional OTP verification, or share them via a link, QR code, WhatsApp, or Facebook.
  • Track when recipients open their card, receive thank-you replies, and set an expiry date after which all uploaded media is permanently deleted.
  • Purchase credit packages via PayPal, Visa, Mastercard, and other supported payment methods.

3. User Responsibilities

  • Provide accurate information when creating cards, including correct recipient email addresses.
  • Not upload, create, or send any content that is illegal, offensive, harmful, defamatory, or infringes upon the rights of others.
  • Ensure you have the necessary rights and permissions for all content you submit — including photos, videos, audio files, and 3D models.
  • Be solely responsible for any content you create and share via the platform.
  • Understand that all uploaded media will be permanently deleted when your card expires, and set expiry times accordingly.
  • Comply with all applicable laws regarding data protection, privacy, and digital communications.

4. User-Generated Content & Media

All messages, photos, videos, audio files, 3D models, and other media you upload remain your property. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to process, display, and deliver your card as intended by the Service.

Important: We do not monitor user-generated content and are not liable for any damages arising from it. All uploaded content is temporary and will be automatically deleted according to our media deletion policy below.

5. Automatic Media Deletion Policy

Privacy by Design: To protect your privacy and minimise data retention, all media files you upload — photos, videos, audio, and 3D models — are automatically and permanently deleted from our servers when your card expires. This includes:

  • Database records of all uploaded media.
  • Physical files stored on our servers.
  • All associated metadata and temporary cache files.

Key points:

  • You set the card’s expiry time when creating it.
  • A countdown timer on your card shows exactly when it will expire.
  • Deletion is automatic and irreversible — no recovery is possible after expiry.
  • Not even platform administrators can access or restore deleted media.

By using the Service, you acknowledge and accept this automatic deletion policy.

6. Email Delivery & Service Limitations

While we strive to ensure successful delivery, we cannot guarantee:

  • Email delivery due to spam filters, incorrect addresses, inbox limits, or third-party issues.
  • Uninterrupted availability of the platform at all times.
  • That the Service will be entirely error-free or meet every expectation.
  • Recovery of expired or deleted cards and media.

OTP verification may be required when a recipient attempts to open a private card, as per your privacy settings.

7. Privacy, Data Protection & Security

By using our Service, you agree that we may collect and process information necessary to operate the platform and deliver your cards, including:

  • Names, email addresses, messages, and uploaded media (temporarily, until card expiry).
  • Payment information processed through secure third-party payment processors.
  • View counts and open notifications if you enable these features.

Our privacy commitments:

  • Temporary storage: Media files are stored only while the card is active.
  • Complete deletion: Expired media is permanently deleted with no backups or recovery.
  • No admin access: Administrators cannot override deletion or access expired content.
  • Transparent process: Countdown timers show exactly when deletion will occur.
  • OTP protection: Private cards require email verification for unlisted recipients.

8. Credits, Payments & Refunds

CardToYou uses a credit-based system for creating and sending cards:

  • Credits can be purchased via PayPal, Visa, Mastercard, and other supported payment methods.
  • Credits are non-transferable and non-refundable except as required by law.
  • All payments are processed securely through third-party payment processors.
  • Prices and credit packages may change without notice, but purchased credits remain valid.

9. Intellectual Property

All templates, designs, code, and branding on the platform are owned by us or licensed for use. You may not copy, modify, distribute, or resell any part of the platform without prior written permission.

10. Third-Party Services & Links

The platform may integrate with third-party services such as payment processors and email providers. We are not responsible for their content, policies, or security measures. Use of third-party services is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Failed or delayed email deliveries due to spam filtering or third-party issues.
  • Loss of data or security incidents beyond our reasonable control.
  • Automatic deletion of expired card media as per our stated policy.
  • Any direct, indirect, incidental, or consequential damages arising from using the Service.
  • Quality, accuracy, or suitability of user-generated content.

Your use of the platform is at your own risk. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Prohibited Uses

You may not use the Service to:

  • Send spam, phishing attempts, or malicious content.
  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Attempt to gain unauthorised access to systems or other user accounts.
  • Interfere with or disrupt the Service’s operation.
  • Upload viruses, malware, or harmful code.

We reserve the right to suspend or terminate accounts that violate these Terms.

13. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our discretion. Upon termination:

  • Unused credits may be forfeited.
  • Active cards may expire immediately.
  • All media associated with your account will be deleted according to our deletion policy.

14. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via email or platform notification. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising from these Terms or use of the Service shall be resolved through good faith negotiation first, or through binding arbitration if negotiation fails.

16. Severability
